When I spoke with the CFC a few years ago, I was told that they had decided internally that clear guns were not replicas, as evidenced by their posted fact sheet on the matter:
http://www.cfc-cafc.gc.ca/factsheets/replica_e.asp As the CFC is now RCMP, their policies regarding enforcement are more likely than not to followed by the CBSA, but not set in stone. The rule of thumb has been for a few years now: Clear = OK Anything but clear = take your chances
