I'm not gonna comment on the seller. As far as I'm concerned this is my fault. I don't hold the seller responsable at all. I failed to safe the gun, and I failed to get to see if it was loaded.

The bigger question is who was dumb enough to send a gun with gas in it , let alone fully loaded with BB's! AND cocked? i mean.. That's the dumb thing in my opinion.. Like, yes you made a careless mistake.. But how about THREE careless mistakes by the sender..

Yeah someone shipped me a fully loaded MP7 to fix once, luckily I check every gun I work on to make sure it's not loaded. He got a good yelling lol

I get "live" guns sent to me all the time, even though I specifically tell the senders to unplug the battery. What's even worse is after I install a Triggermaster an tell the client not to leave the battery plugged in as it will be slowly drained by the mosfet. And they promptly ignore me, potentially pooching their MiMH Batteries.
